WALR KISS104 LIVE FREE FOR A YEAR CONTEST
OFFICIAL RULES
1. NO PURCHASE NECESSARY TO ENTER OR TO WIN. A PURCHASE WILL NOT IMPROVE YOUR CHANCES OF WINNING. ALL FEDERAL, STATE, LOCAL AND MUNICIPAL LAWS AND REGULATIONS APPLY. VOID WHERE PROHIBITED.
2. Eligibility. Subject to the additional restrictions below, the WALR KISS104 "Live Free For A Year Contest" (the "Contest") is open to legal residents of the state of Georgia who are 18 years or older with a valid Georgia Driver's License or Georgia State Issued ID (or other proof of Georgia residency, such as a copy of a utility bill) at the time of entry. Employees of Cox Radio, Inc. d/b/a WALR-FM ("Sponsor"), and each of its affiliated companies, subsidiaries, and advertising and promotional agencies, and the family members of, and any persons domiciled with, any such employees, are not eligible to enter or to win. The term "family members" includes spouses, parents, grandparents, siblings, children, grandchildren and in-laws, regardless of where they live.
3. Contest Period and Structure. The Contest will begin at 10:00 a.m. (E.T.) on Monday, September 22, 2014 and end at 6:00 p.m. (E.T.) on Friday, November 21, 2014 (the "Contest Period") and consists of Hourly Prizes, App Prizes, and a Grand Prize and how to enter for each prize is described in the relevant section below. Sponsor will be the official timekeeper for the Contest.
4. To Enter for an Hourly Prize
To enter for a chance to win an Hourly Prize, you must complete the following steps:
- Turn on KISS 104.1 FM every weekday during the Contest Period (each, a "Contest Day") at the following times (E.T.): 10:00 a.m., 11:00 a.m., Noon, 1:00 p.m., 2:00 p.m., 3:00 p.m., 4:00 p.m., and 5:00 p.m.
- Listen for the DJ to announce that he/she is about to play the Song of the Hour.
- Once the Song of the Hour ends (as specified explicitly by the DJ), be the 14th caller @ 404-741-0104 (the "Contest Line") to be declared a potential Hourly Prize winner
The potential Hourly Prize winner must be the participant who originally dialed the phone to the radio station to participate in the Contest. No family members, friends, office associates, or any other person will be allowed to participate in the Contest on another person's behalf. The participant must provide his or her own name as listed on his or her valid Georgia Driver’s License, Georgia State Issued ID, or other proof of Georgia residency. If a contestant uses a false name, an invalid Georgia Driver’s License or Georgia State Issued ID, or another person's Georgia Driver’s License or Georgia State Issued ID, he or she will be immediately disqualified from the Contest and be ineligible to win any prize.
Telephone calls will be taken by Contest operators in the order they are received, and the operators will count the number of calls received after the end of each Song of the Hour announcement to determine the 14th caller. The determinations of Sponsor and Contest operators will be final and binding in all respects.
Enter to win an Hourly Prize as often as you like, provided that the use of automatic telephone dialing equipment or other software or computer assisted dialing equipment is prohibited and may result in your disqualification.
Sponsor will not be responsible for loss of service to the Contest Line or for a contestant’s failure to reach the Contest Line due to malfunction of any network or system, congestion, overload, busy signals, cell phone drop out, or any other factor that may prevent an individual from completing his/her phone call. In the event of interruption of power or telephone service during the designated call-in times of the Contest and prior to identifying and accepting the 14th caller, or a change in programming that results in Sponsor’s inability to air a call-in opportunity, the call-in period affected by the interruption may or may not be replayed at the resumption of service, at Sponsor’s sole discretion. In the event a 14th caller gets disconnected before being declared a winner, Sponsor may resume the call-in opportunity affected and declare the next caller a winner, pending verification of eligibility and compliance with these Official Rules. Sponsor will not be responsible for dropped calls from mobile devices or land lines and dropped calls may result in the potential winner’s disqualification and forfeiture of all interest in any prize.
Listeners accessing Sponsor’s station audio via IP connections like website-based streaming or mobile devices are welcome to enter. However, Sponsor will not be responsible for delays in electronic transmission of station audio to IP devices. By entering a Contest, listeners acknowledge their understanding and agreement to this specific provision within these Contest Rules.
5. To Enter for an App Prize
To enter for a chance to win an App Prize, you must complete the following steps:
- During or before the Contest Period, download and install the "KISS104" mobile app (the "App") on a compatible mobile device from either the iTunes App Store or the Google Play store.
- Using the Contest link within the App, complete and submit the Contest registration form. All of the required information must be provided, and all of the information you provide must be complete and accurate. Standard data rates may apply.
- After the close of each Contest Day, Sponsor will select one (1) potential App Prize winner in a random drawing from among all eligible entries received during the Contest Period.
Failure to complete any of the steps in this section may result in the disqualification of your attempted entry as determined in Sponsor’s sole discretion. Upon Sponsor’s receipt of your Message and completed entry form, you will receive one (1) entry into the Contest. Limit one (1) entry for a chance to win an App Prize per person and per household during the Contest Period regardless of whether you enter via the Android App or the iOS app. The use of multiple identities and/or accounts is prohibited, and any attempt to obtain more than the stated number of entries will void that participant’s entries and may result in participant’s disqualification. All entries become property of Sponsor and none will be returned. Any questions regarding the number of entries submitted shall be determined by Sponsor in its sole discretion, and Sponsor reserves the right to disqualify any entries by persons who submit false or misleading information.
BY ENTERING THE CONTEST, YOU ACKNOWLEDGE AND AGREE THAT KISS104.1 MAY PLAY YOUR RECORDED MESSAGE OR ANNOUNCE YOUR NAME LIVE ON-AIR IF YOU ARE RANDOMLY SELECTED AS A POTENTIAL WINNER AND YOU HEREBY CONSENT TO THE STATION DOING SO. YOU ALSO REPRESENT AND WARRANT THAT YOU ARE SUBMITTING YOUR CONTEST ENTRY ON YOUR BEHALF AND NOT ON BEHALF OF ANY OTHER INDIVIDUAL.
Sponsor will not be responsible for failure to receive entries or for a contestant’s failure to record or submit an audio message with the app’s Open Mic feature due to transmission failures or technical failures of any kind, including, without limitation, malfunctioning of any network or device, whether originating with sender, Sponsor, or sender’s Internet service provider. Sponsor is not responsible for any issue that may prevent a contestant from being able to download or access the app or complete his/her entry.
6. To Enter to for the Grand Prize
Each of the 320 Hourly Prize winners and the 40 App Prize winners will be entered to win the Grand Prize. There is no other method to enter to win a Grand Prize. On or about October 19, and November 21, 2014, Sponsor will select two (2) potential Grand Prize winner in a random drawing from among all eligible entrants.
7. Odds and Prize Descriptions
The odds of winning an Hourly Prize depends upon the number and timing of the calls to the Contest Line after the end of the relevant Song of the Hour. The odds of winning an App Prize depends upon the total number of entries submitted during the relevant Contest Day. The odds of winning the Grand Prize are 1:359, provided, however, that only those who have been selected as potential Hourly Prize or App Prize winners will be entered to win the Grand Prize.
Hourly Prize. Each of the 320 potential Hourly Prize winners will, upon verification of eligibility and compliance with these Official Rules, be awarded one chance to spin the Prize Wheel and will win the corresponding Prize (described below).
App Prize. Each of the 40 potential App Prize winners will, upon verification of eligibility and compliance with these Official Rules, be awarded $104.00 as qualifying prize.
Grand Prize. The one (1) potential Grand Prize winner will, upon verification of eligibility and compliance with these Official Rules, be awarded $35,000 in the form of a check.
Limit one (1) App Prize or Hourly Prize per person in this Contest and limit one (1) Grand Prize per person in this Contest. In addition, only one (1) prize per person per household every thirty (30) days for any contest sponsored by any of the CMG-Atlanta radio stations (i.e., WSB-AM, WSB-FM, WSB, WALR and WSRV) unless the Official Rules for the contest explicitly states otherwise.
The approximate retail value of all prizes to be awarded in this Contest is a maximum of $107,000 and will vary depending upon the winner’s bills.
8. Winner Notification and Acceptance.
Potential Hourly Prize winners will be notified while on the phone with the Contest Line. Potential App Prize winners will be notified by the provided phone number or other contact information as determined in Sponsor’s sole discretion. The potential Grand Prize winner will be notified via telephone or other contact method as determined by Sponsor in its sole discretion.
Potential Hourly, App, and Grand Prize winners may be required to complete an affidavit of eligibility, and a liability and publicity release (except where prohibited by law), which is available on the Contest page at http://www.kiss104fm.com.
To claim any prize, potential winners must visit the Sponsor’s offices at 1601 West Peachtree Street NE, Atlanta, Georgia 30309 within fourteen (14) business days after notification. Office visits must be between the hours of 9:00 a.m. (E.T.) and 5:00 p.m. (E.T.) weekdays.
For identification purposes, winners must also show Sponsor valid government-issued identification before claiming any prize. Any winner with government-issued ID that is not issued by the State of Georgia must also submit a copy of a utility bill to show proof of Georgia residency before claiming any prize. Failure to present the required proof of residency may, at the sole discretion of Sponsor, result in a winner’s disqualification and the forfeiture of his or her interest in any prize.
Sponsor’s inability to reach a potential winner after a reasonable (as solely determined by Sponsor) effort has been made, the failure of a potential winner to timely respond to a prize notification, the return of any prize notification as undeliverable, and/or a potential winner’s failure to comply with any term or condition of these Official Rules may, in Sponsor’s sole discretion, result in the potential winner’s disqualification and forfeiture of all interest in any prize.
A PARTICIPANT IS NOT A WINNER OF ANY PRIZE UNLESS AND UNTIL SPONSOR HAS COMPLETED ITS VERIFICATION OF PARTICIPANT’S ELIGIBILITY.
A winner may waive the right to receive a prize. Prizes are non-assignable and nontransferable. No substitutions are allowed by winner. Winner is solely responsible for reporting and payment of any taxes on a prize. Winner may be required to provide his/her valid Social Security Number to Sponsor for tax purposes and/or complete an IRS W-9 form (if applicable) in order to claim a prize. Winners are solely responsible for all federal, state and local taxes on prize value and, as applicable, will be issued an IRS Form 1099 based on the prize value determined by Sponsor. Prizes not won and claimed by eligible winners in accordance with these Official Rules will not be awarded and will remain the property of Sponsor.
9. Publicity. Except where prohibited, acceptance of any prize constitutes the winner's irrevocable consent to the publication or other use by Sponsor and its licensees of his or her name, biographical information and likeness in any media, including the Internet, for any commercial, publicity or promotional purpose, without limitation, review or approval, or additional compensation. In addition, participants acknowledge that telephone calls placed to the Contest Line may be recorded for use on-air any time.
10. Participation. By participating, participants agree to be bound by these Official Rules and the decisions of Sponsor and any Contest judges or administrators selected by Sponsor, which are final and binding in all respects. Sponsor reserves the right to disqualify persons found tampering with or otherwise abusing any aspect of this Contest as solely determined by Sponsor. In the event the Contest is compromised by a virus, non-authorized human intervention, tampering or other causes beyond the reasonable control of Sponsor which corrupt or impair the administration, security, fairness or proper operation of the Contest, Sponsor reserves the right in its sole discretion to suspend, modify or terminate the Contest. Should the Contest be terminated prior to the stated expiration date, Sponsor reserves the right to award prizes based on the entries received before the termination date. Proof of sending or submission of an entry will not be deemed proof of receipt by Sponsor.
11. Release. BY PARTICIPATING IN THE CONTEST, EACH PARTICIPANT AGREES TO FULLY RELEASE, FOREVER DISCHARGE AND HOLD HARMLESS SPONSOR, COX MEDIA GROUP, LLC, COX ENTERPRISES, INC., AND THEIR RESPECTIVE SUBSIDIARIES, AFFILIATES, SUPPLIERS, DISTRIBUTORS, ADVERTISING/PROMOTION AGENCIES, AND PRIZE SUPPLIERS AND EACH SUCH COMPANY'S OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, REPRESENTATIVES, AND SUCCESSORS AND ASSIGNS (COLLECTIVELY, THE "RELEASED PARTIES") FROM AND AGAINST ANY CLAIMS, COSTS, LIABILITIES, LOSSES, INJURIES, AND DAMAGES ARISING OUT OF THE CONTEST, INCLUDING, BUT NOT LIMITED TO, ANY CLAIMS FOR PERSONAL INJURY, DEATH, OR DAMAGE TO OR LOSS OF PROPERTY, LOSS OF ENJOYMENT, OR ANY OTHER HARM WHATSOEVER ARISING OUT OF: (1) PARTICIPATION IN THE CONTEST; (2) THE QUALITY, RECEIPT, POSSESSION, USE, OR MISUSE OF ANY PRIZE; OR (3) ANY TRAVEL OR ACTIVITY THAT IS RELATED TO THE CONTEST OR ANY PRIZE.
12. Limitations of Liability. BY PARTICIPATING IN THE CONTEST, PARTICIPANTS ACKNOWLEDGE AND AGREE THAT EVERYTHING REGARDING THIS CONTEST, INCLUDING THE WEBSITE AND THE PRIZE(S), ARE PROVIDED "AS IS" AND THAT SPONSOR MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, ABOUT THE PRIZE(S) AND SPONSOR HEREBY DISCLAIMS ALL SUCH WARRANTIES, INCLUDING, BUT NOT LIMITED TO, ANY IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. (BECAUSE SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN IMPLIED WARRANTIES, THE ABOVE LIMITATION MAY NOT APPLY TO YOU. IN SUCH STATES, THE LIABILITY OF THE RELEASED PARTIES IS LIMITED TO THE FULLEST EXTENT PERMITTED BY SUCH STATE LAW.)
The Released Parties are not responsible for: (1) any incorrect or inaccurate information, whether caused by PARTICIPANTs, printing OR PRODUCTION errors, or by any of the equipment or programming associated with or EMPLOYED in the Contest; (2) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the entry process or the Contest; (4) technical or human error which may occur in the administration of the Contest, the processing of entries, or the notification of any winner; or (5) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from A PARTICIPANT'S participation in the Contest or receipt or use or misuse of any prize.
Only the number of prizes stated in these Official Rules is available to be won in the Contest. In the event that production, technical, seeding, programming, or any other reasons cause more than the stated number of prizes as set forth in these Official Rules to be available and/or claimed, Sponsor reserves the right to award the prizes by a random drawing among all legitimate eligible prize claims.
13. Construction. The invalidity or unenforceability of any provision of these rules shall not affect the validity or enforceability of any other provision. In the event that any such provision is determined to be invalid or otherwise unenforceable, these Official Rules shall be construed in accordance with their terms as if the invalid or unenforceable provision was not contained therein.
14. Sponsor. The WALR KISS 104 Live Free for a Year Contest is sponsored by Cox Radio, Inc. d/b/a WALR-FM. The decisions of Sponsor regarding the selection of winners and all other aspects of the Contest shall be final and binding in all respects. Sponsor will not be responsible for typographical, printing, or other inadvertent errors in these Official Rules or in other materials or announcements relating to the Contest.
